График отпусков – это документ, который утверждается работодателем с учетом мнения профсоюза не позднее, чем за две недели до календарного года. Основные вопросы, которые возникают у работников при утверждении графика:

Обязан ли работодатель при составлении графика учитывать их пожелания?

Не обязан в отношении большинства работников. Такая практика, безусловно, есть, но она основана не на законе, а на лояльности работодателя. Но обязан учитывать пожелания работников, имеющих право на отпуск в любое удобное время, а также обязан учитывать мнение профсоюза, объединяющего более 50% работников.

Нужно ли в график вносить изменения в отношении вновь принятых работников?

Не нужно. Первый отпуск им предоставляется не по графику, а на основании заявления по истечении 6 месяцев работы.

Можно ли перенести отпуск, установленный графиком, на другое время?

Да, по соглашению сторон. Либо если работнику своевременно не была произведена оплата отпуска или он не был предупрежден о времени начала отпуска.

Нужно ли вносить в график отпуска, не использованные за текущий год?

Нужно. При этом работодатель обязан будет учитывать пожелание работника, так как в случае переноса отпуска на другой срок, он определяется с учетом пожеланий работника.

Можно ли отказаться от разделения отпуска на части и требовать включить его в график в полном объеме?

Да, это право работника. Разделение отпуска на части возможно только по соглашению сторон, при этом одна из частей отпуска должна быть не менее 14 дней.

Должен ли работодатель извещать работника об отпуске по графику?

Да, о начале отпуска обязаны уведомить работника под роспись не позднее чем за две недели до его начала. В случае невыполнения этой обязанности, работник вправе перенести отпуск.

Можно ли заменить неиспользованные дни отпуска на денежную компенсацию?

Можно. За часть отпуска превышающую 28 дней на основании заявления работника, либо при увольнении.

Заменить денежной компенсации нельзя основной оплачиваемый отпуск всем и дополнительные отпуска беременным женщинам, несовершеннолетним работникам, а также работникам с опасными условиями труда.
